Tailgate soft close keeps pulling the tailgate in and out.

Just wondered if anyone else has had issues with there tailgate soft close mechanism?.
At the moment when you close our tailgate the soft close mechanism pulls the tailgate shut and then pushes it back out about 3 times stopping usually in the out position.
Sometimes it rest in the shut position but not usually, when I spoke to BMW parts they said we had the soft close option and wanted a few hundred quid for a new mechanism of this was causing the issue.
So just wondered if anyone else has had this? and my other thought was could I modify the soft close mechanism so the locking pin/ ring was fixed so the tailgate just locks in place when it's fully home.
