I think you have to be physically in contact with the device for it to be constituted as illegal.

Bit of a strange law. An iPod touch is fully legal to control  / hold for music and anything else.

An iPhone, doing the same thing, but it has a SIM in it - is illegal to hold.

A walkie talkie is fine to use as well - but a phone with walkie talkie facility is not as there is a SIM in there.

How can an iPod touch be ok to hold and and not a phone? One could be scrolling through a playlist trying to find 'You Can Leave Your Hat On' and be just as dangerous.
Rubberneckers are strange folk - never understood that mindset.

No it isn't.  You get dealt with for driving without due care, or not being in proper control of a motor vehicle, rather than the very specific phone offence.

Some insurers are cancelling policies of those with mobile phone convictions.  Absolutely right too, especially those driving trucks.

i personally agree, i dont drive on the phone however i used to years ago, i would say many people would still be better drivers and more aware of their surroundings than some of the idiots that are not aware of anything further than the end of their bonnet.
Also a conversation / arguement with someone in the car could be way more distracting than a phone.

Please note im meaning a phone conversation holding phone agains ear, there is no way when these people are reading facebook, texts etc that they are safe and aware, i just mean having a phone against ear is bearly any different to a handfree, especially in an auto car.

Personally ?I prefer not to use the phone whilst mobile, even hands free.

The folks I work for, and the RAF who's vehicles I occasionally use, ban mobile use completely unless parked.

When i used to do it it was legal!  then a £30 fine, stopped when the points came in, just saying you can be on a phone and be safe and aware, just as you can be not on the phone but looking somewhere else and still crash.

To the original post i think its sick people videoing crash scenes as in the days of todays social media etc it could be possible family members etc see the footage before police have had time to work out who people are
