I think there was an article in last week's Auto Express about these 'fraudulent' whiplash claims as it's almost impossible to disprove.
The answer may well be to adopt Germany's approach - no claims will be accepted for impacts at less than 10km/h.
Given this one is a 'no damage' claim, I suspect under the German rules it would be chucked out.
I hope the insurers win but sadly it is often easier to make an 'offer' and get out, than pursue it as 'iffy', which is of course what the 3rd party hopes for.
Years ago I got hit behind by a magistrate of all people whilst stationery at roadworks - she was talking to her passenger until too late, and not looking forward. She refused to pay up becuase I had involved my insurers. Both of us in my car suffered minor whiplash, but never thought any more about it. In the end my insurers sued her for the cost of repairs and won (no surprise really). It never ocurred to either of us to claim for whiplash - that was just something that happended in car crashes and not something you tried to get ££££'s in compensation for.
