It does work on vista as I have it installed. Think I had to plug into the OBD via the cable provided and then install the disc again. Just loading it into the laptop first and plugging it in doesn't do anything for some strange reason.

It should work on Vista fine. If your having driver problems then disabling the signed driver check may cure your issue.
Open the Start menu and select "All programs."
Navigate to "Accessories" and right-click on "Command Prompt."
Select "Run as Administrator."
Type "bcdedit.exe /set nointegritychecks ON" in the black window and press "Enter."
Reboot the computer.

Poss as the interface derived power from the car rather than the USB port.
Therefore when not plugged into the car the PC won't see anything??
maybe?

correct as far as mine is concerned, although that applies regardless of the OS
that happened to me and then somebody here suggested that i try hooking it up into the car and then installing it. that worked as it got powered by the car.
it is easily observable - the power led comes up only when its hooked up to the car, not the usb.

Only a long shot as I'm not sure how far you have got with the installation.
I seem to remember that it didn't install the drivers automatically but once you have installed the program there is a folder on the hard drive ( BMWScan ) with the drivers in and a .pdf file explaining how to install them .
Once the drivers are installed if you run the program you get an error if it isn't hooked up to the car
